TERMS AND CONDITIONS
Before you can bid online at Bid416.com, you must read and agree to the bid terms. Please read these terms carefully. When you register/bid, you enter into a binding legal agreement with Bid416 Auctions. Your email address will automatically be added to our mailing list and you will receive notifications of upcoming auctions when you agree to these terms and conditions.
PAID
Payments are made in Canadian funds via Visa, Mastercard, DiscoveroreTransfers (toinfo@Bid416.com) prior to item pickup.
Payments must be received no later than the Saturday after the auction.
We reserve the right to charge the credit card on file if payment is not received by the end of the day on Saturday.
All sales are final.
Collection of won items/lots
Pickup addresses and times are listed in the auction description under Shipping Information.
articlesHAS TObe picked up on Saturday or Sunday or Monday or Tuesday (every day from 10 am to 3 pm) immediately after the auction in which the items were won.
Items not picked up by the end of the day on the Tuesday following the weekly auction will be considered lost and may be relisted.
There are no refunds or credits for items that have been lost due to not being picked up.
OFFER AND BUY
All offers made are final and irrevocable. If you are the highest bidder, you are the new owner of that item. All sales are final. Each item becomes the responsibility of the new owner once the item is sold. If you are the highest bidder, you are responsible for insuring your purchase if necessary. Buyers may not take possession or dispose of their purchases until the full purchase price (including any applicable taxes or fees) has been paid in full. A receipt will be provided to the buyer for items paid for and is required to pick up lots/items. It is the Proposer's responsibility to determine the make, model, condition, age, authenticity, value, or any other determining factor. Bid416.com will attempt to describe merchandise in descriptions, advertisements, on the Internet and/or in a catalog, but is not responsible. In no event shall Bid416 Auctions be liable to make or imply any warranty of merchantability or fitness for a particular purpose. The Bidder is the sole appraiser of the security. Online bidders understand and acknowledge that they may not be able to inspect an item as closely as if they had examined it in person. It is the Bidder's responsibility to determine the condition, age, authenticity, value or any other determining factor before bidding on the items. Bid416 Auctions will endeavor to detail each item and all relevant information about it. Bid416 Auctions is not responsible for any technical problems or errors in online bidding that the bidder may experience. Bidder agrees that everything is sold as is and that you may not return any item you purchase. Under no circumstances may a bidder file a claim against Bid416 Auctions or anyone else if the Internet service is not working properly. Bid416 Auctions is not responsible for lost bids from any source. All properties are sold "AS IS - WHERE IS", and ALL SALES ARE FINAL.
ADDITIONAL TERMS
Bid416 Auctions reserves the right to add, remove or change items once this auction has been listed and posted. Bid416 Auction has the right to cancel or postpone the auction at any time without notice. Once on the site; Bid416 Auctions and/or the Landlord are not responsible for any accident; you and your belongings have entered the premises at your own risk and assume your own responsibility. Bid416 Auction has the right to accept and/or reject all bids. All gas/electric and plumbing disconnections MUST be performed by a licensed professional. All disconnections and transportation/relocation costs are the responsibility of the successful bidder.
USE AND REGISTRATION
Our services are only available to and may only be used by persons who can enter into legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to children (persons under the age of 18) or members temporarily or indefinitely suspended. If you are under the age of 18, you may only use this service with the cooperation and supervision of your parent or guardian. If you are not eligible, please do not use our service. If you register as a business entity, you represent that you have the authority to bind the entity to the Terms and Conditions.
REGISTRATION REQUIREMENTS
In consideration of your use of the Service, you agree to: (a) provide true, accurate, current, and complete information about yourself as prompted by the Service's registration form (such information is "Bidder Information") and (b) maintain and promptly update the Registration Information to keep it true, accurate, current and complete. If you provide false, inaccurate, out-of-date or incomplete information, or if Bid416 Auction has reasonable grounds to suspect that such information is false, inaccurate, out-of-date or incomplete, Bid416 Auction has the right to suspend or terminate your account. any and all current or future use of the Service (or any part thereof).
LIMITATION OF LIABILITY
You expressly understand and agree that Bid416 Auctions shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Bid416 Auctions has been advised of the possibility of such damages) resulting from: (i) the use or inability to use the service; (ii) the cost of purchasing substitute goods and services resulting from goods, data, information or services purchased or obtained or messages received or transactions made through or from the Service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Service; or (v) any other matter related to the service.
EXCLUSIONS AND LIMITATIONS
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations in the preceding paragraphs may not apply to you.
COMPENSATION
You agree to indemnify and hold Bid416 Auctions harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or due to your breach of this Agreement or the documents it contains by reference, or your breach of any law or the rights of a third party.
LEGAL ACCOMPLICE
You must comply with all applicable national and international laws, statutes, ordinances, and regulations regarding your use of our service and your offers, postings, purchases, requests for offers to buy, and sales of items.
GENERAL INFORMATION
The TAC constitutes the entire agreement between you and Bid416 Auctions and governs your use of the Service, superseding any prior agreements between you and Bid416 Auctions. The TAC and the relationship between you and Bid416 Auctions are governed by the laws of the Province of Ontario without regard to its conflict of law provisions. You and Bid416 Auctions agree to submit to the personal and exclusive jurisdiction of the courts located within the province of Ontario, Canada. The failure of Bid416 Auctions to exercise or enforce any right or provision of the TAC shall not constitute a waiver of such right or provision. If any provision of the TAC is found by a court of competent jurisdiction to be invalid, the parties agree, however, that the court should endeavor to give effect to the intentions of the parties as reflected in the provision, and the other provisions of the TAC.
